These Terms of Service (“Terms”) govern your use of RankUpFaster’s website, services, and products. By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Services Overview

1.1 What We Provide

RankUpFaster provides local search engine optimization (SEO) services specifically designed for cleaning companies and other local service businesses, including but not limited to:

  • Google Business Profile optimization
  • Local citation building and management
  • Local link building
  • Review generation and management
  • Website optimization for local search
  • Local SEO audits and consulting
  • Content creation for local search visibility
  • Ongoing local SEO campaign management

1.2 Service Customization

All services are customized based on your specific business needs, service area, and market competition. Service deliverables may vary based on the package you select.

2. Account and Service Agreement

2.1 Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of your business to use our services.

2.2 Service Enrollment

When you sign up for RankUpFaster services:

  • You provide accurate, complete, and current information about your business
  • You maintain and update this information to keep it accurate
  • You’re responsible for all activities under your account
  • You agree to notify us immediately of any unauthorized use of your account

2.3 Service Term

  • Services begin on the date specified in your service agreement
  • Most packages operate on a month-to-month basis unless otherwise specified
  • Either party may terminate services with 30 days’ written notice
  • Some specialized projects may have fixed-term agreements

3. Payment Terms

3.1 Pricing and Fees

  • Service pricing is outlined in your specific service agreement or proposal
  • Prices are subject to change with 30 days’ notice
  • Current clients are grandfathered at their existing rate for 12 months from any price increase
  • Setup fees (if applicable) are one-time, non-refundable charges

3.2 Billing and Payment

  • Services are billed monthly in advance unless otherwise agreed
  • Payment is due within 5 business days of invoice date
  • Accepted payment methods: Credit card, ACH transfer, or wire transfer
  • A $35 fee applies to failed payment attempts or declined cards
  • Late payments (15+ days overdue) may result in service suspension

3.3 Refund Policy

  • Free Audits: Completely free with no refund necessary
  • Monthly Services: No refunds for current month services already rendered
  • Setup Fees: Non-refundable once work has begun
  • Custom Projects: Refunds evaluated on a case-by-case basis
  • Satisfaction Guarantee: If you’re not satisfied within the first 30 days, we’ll work with you to make it right or provide a prorated refund for unused services

4. Client Responsibilities

4.1 Information and Access

You agree to provide:

  • Accurate business information (name, address, phone, website, etc.)
  • Access to necessary accounts (Google Business Profile, website backend, etc.)
  • Timely responses to requests for information or approvals
  • Existing brand assets (logos, photos, brand guidelines)

4.2 Cooperation

You agree to:

  • Respond to client questionnaires and requests within 5 business days
  • Attend scheduled calls or meetings (or reschedule with 24 hours’ notice)
  • Review and approve deliverables in a timely manner
  • Not make contradictory changes to your online presence that interfere with our work

4.3 Content and Reviews

  • You’re responsible for the accuracy of information you provide
  • You won’t request or incentivize fake reviews
  • You’ll respond professionally to customer reviews
  • You understand that review generation must comply with platform guidelines

5. Our Responsibilities and Limitations

5.1 What We Promise

We will:

  • Use industry-standard, white-hat SEO practices
  • Provide transparent monthly reporting
  • Communicate proactively about your campaign
  • Work diligently to improve your local search visibility
  • Comply with Google’s Webmaster Guidelines and Terms of Service

5.2 What We Don’t Promise

We explicitly DO NOT guarantee:

  • Specific ranking positions (e.g., “#1 on Google”)
  • Specific amounts of traffic or leads
  • Immediate results (SEO takes 60-90+ days to show significant results)
  • Protection against Google algorithm updates
  • Results if you don’t implement our recommendations

5.3 Factors Beyond Our Control

Results may be affected by:

  • Google algorithm changes
  • Your industry competition level
  • Your business reputation and reviews
  • Your website quality and user experience
  • Your service area population and search volume
  • Actions taken by you or third parties outside our recommendations

6. Intellectual Property

6.1 Your Property

You retain ownership of:

  • Your business name, trademarks, and branding
  • Content you provide to us
  • Your website (if we don’t build it)
  • Your Google Business Profile and other listings

6.2 Our Property

RankUpFaster retains ownership of:

  • Our proprietary processes, methodologies, and systems
  • Templates, frameworks, and tools we’ve developed
  • Our brand name, logo, and marketing materials

6.3 Work Product

  • Content we create for you (blog posts, service pages, etc.) becomes your property upon full payment
  • We may retain samples for portfolio purposes with your permission
  • We may use anonymized case study data for marketing purposes

7. Confidentiality

7.1 Confidential Information

Both parties agree to keep confidential:

  • Business strategies and financial information
  • Customer lists and proprietary data
  • Login credentials and access information
  • Any information marked as confidential

7.2 Exceptions

Confidentiality doesn’t apply to information that:

  • Is publicly available
  • Was known prior to disclosure
  • Is independently developed
  • Must be disclosed by law

8. Termination

8.1 Termination by Either Party

  • Either party may terminate with 30 days’ written notice
  • No penalties for termination (we don’t believe in locking you in)
  • You’ll be billed for services provided through the termination date

8.2 Immediate Termination

We may terminate immediately if:

  • You fail to pay invoices after 30 days
  • You violate these Terms
  • You engage in illegal activities
  • You request black-hat or unethical SEO practices
  • You’re abusive to our team members

8.3 Effects of Termination

Upon termination:

  • You’ll receive a final invoice for services rendered
  • We’ll provide a transition document summarizing work completed
  • You retain access to all assets created for you (after final payment)
  • We’ll remove our access to your accounts within 5 business days
  • Ongoing subscriptions or services we manage on your behalf are your responsibility to maintain

9. Limitation of Liability

9.1 Service Limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • RankUpFaster’s total liability shall not exceed the total amount you paid us in 1 month before the claim
  • We’re not liable for indirect, incidental, special, or consequential damages
  • We’re not liable for lost profits, revenue, data, or business opportunities
  • We’re not liable for actions taken by Google or other third-party platforms

9.2 Force Majeure

We’re not liable for delays or failures caused by circumstances beyond our reasonable control, including:

  • Natural disasters
  • Government actions or regulations
  • Internet or hosting failures
  • Third-party platform changes (Google algorithm updates, policy changes, etc.)
  • Pandemics or public health emergencies

10. Warranties and Disclaimers

10.1 Our Warranties

We warrant that:

  • Services will be performed with reasonable skill and care
  • We have the right to provide the services
  • We’ll comply with applicable laws and regulations

10.2 Disclaimer

EXCEPT AS EXPRESSLY STATED, SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We make no warranties about:

  • Specific results or outcomes
  • Compatibility with all systems or platforms
  • Uninterrupted or error-free service
  • Third-party actions or services

11. Indemnification

You agree to indemnify and hold RankUpFaster harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of third-party rights
  • Content or information you provide to us
  • Your business operations or services

12. Dispute Resolution

12.1 Informal Resolution

Before filing any claim, you agree to contact us at hello@rankupfaster.com to attempt informal resolution.

12.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in [Your State] under the American Arbitration Association rules, except:

  • Either party may seek injunctive relief in court

16. Acceptance

By using RankUpFaster’s services or website, you acknowledge that:

Here’s what these Terms mean in everyday language:

✅ Services: We provide local SEO services to help your cleaning business rank better on Google.

✅ Payment: You pay monthly in advance. We don’t lock you into long contracts.

✅ Your Part: Give us accurate info, respond to our requests, and don’t mess with what we’re optimizing.

✅ Our Part: We’ll work hard using ethical SEO practices, but we can’t guarantee specific rankings because Google controls that.

✅ Cancellation: Either of us can cancel with 30 days’ notice. No hard feelings.

✅ Problems: If something goes wrong, let’s talk it out first. If we can’t resolve it, we’ll use arbitration.

✅ Liability: Our maximum liability is what you paid us in the last month. We’re not responsible for Google’s decisions.

✅ Your Stuff: You keep ownership of your business assets and content we create for you (after payment).
